Elsewhere, Mark has apologized for our lack of output lo these past months, and it has largely been because the period of September through December is what some affectionately call “silly season” in the legal world, as everyone and their dog seems to think that these months are a good time to load up on a ton of extra work.

I personally have been involved in defending veterans against SLAPP suits and the same petitions for certiorari that Mark discussed in his post. Needless to say, FAFOrg has been quite busy tilting at the windmill of Texas courts’ steadfast refusal to admit that a single bad law is just badly drafted and send the legislature back to the drawing board. The question I want to discuss is my amateur psychological/midwit philosophical analysis as to why everyone is expending so much energy to save this law.
